Turkey: Dodd-Frank, Consumer Protection Act

The Regulation on Refurbished Products (“Regulation”), published in the Official Gazette dated 27 June 2026 and numbered 33293, entered into force on 1 August 2026. The Regulation repealed the Regulation on the Sale of Refurbished Products, which had constituted the main regulatory framework for the refurbished products market since 22 August 2020, and substantially reorganized the system governing the refurbishment, certification and sale of refurbished products.

This article examines the Turkish legal framework for distance sales and its implications for foreign businesses supplying consumers through websites, applications and online marketplaces. It considers pre-contractual information, payment acknowledgement, withdrawal rights, exceptions, refunds, return costs and platform responsibilities. The discussion also addresses cross-border transactions and the Court of Cassation decisions cited in the article. The analysis treats compliance as a purchasing-process issue rather than a standard-form drafting exercise. Its practical focus is the alignment of consumer-facing information, contractual terms, technical checkout arrangements and the evidence needed to respond to a complaint or regulatory inquiry.

Dünyadaki diğer hukuk sistemlerinde ülkemize kıyasla daha erken tarihlerde gelişim gösteren genel işlem koşulları, sözleşmenin güçsüz tarafını, güçlü tarafça kendisine dayatılan uzun, karmaşık ve matbu sözleşme metinlerinin yorumlanması bakımından korumaya yönelik bir yasal düzenleme niteliği taşımaktadır. Under the phrase set out in Article 48(6)(d) of the LPC, operators of electronic commerce marketplaces acting as intermediary service providers were exempted from liability for the exercise of consumers’ alternative rights in respect of defective goods as regulated under Article 11 of the LPC — even where such operators collected payment on behalf of the seller or supplier.

ETK m.9(1) ise aracı hizmet sağlayıcıları, diğer kanunlarda aksine hüküm bulunmadıkça, hizmet sağlayıcı tarafından sunulan içerik ile içeriğe konu mal veya hizmetle ilgili hukuka aykırı hususlardan genel olarak muaf kılmaktaydı.
