Anayasa Mahkemesi’nin (“AYM“) 2026/49 esas ve 2026/48 karar sayılı kararı (“Karar“), 21 Mayıs 2026 tarihli ve 33260 sayılı Resmî Gazete’de yayımlanmıştır. Karar’da AYM, 6100 sayılı Hukuk Muhakemeleri Kanunu’nun (“HMK“) 362. maddesinin (1) numaralı fıkrasının (a) bendini, “istinaf başvurusunun kısmen veya tümden kabulü hali” yönünden Anayasa’nın 13. ve 36. maddelerine aykırı bularak oybirliğiyle iptal etmiştir.

AYM, 2942 sayılı Kamulaştırma Kanunu’nun (“Kanun“) 10. maddesinin sekizinci fıkrasının sekizinci cümlesinde yer alan “Tescil hükmü kesin olup,…” ibaresini Anayasa’nın 13., 35. ve 46. maddelerine aykırı bularak oybirliğiyle iptal etmiştir.

Across modern competition regimes, on-site inspections occupy a central place among the investigative tools of competition authorities and the Turkish Competition Authority (the “TCA”) is no exception, having been entrusted with broad powers to carry out such inspections to detect covert infringements of Law No. 4054 on the Protection of Competition (“Law No. 4054”). Although the scope of these powers has attracted constitutional debate in the legal literature, the TCA’s consistent decisional practice has, in practice, led to the crystallisation of generally accepted standards.

Bu kapsamda, Rekabet Kurumu, Sermaye Piyasası Kurulu ve Kamu Gözetimi, Muhasebe ve Denetim Standartları Kurumu'nun kurul kararı niteliğindeki işlem ve eylemlerinden doğan dava ve işler ile Kamu İhale Kurulunun belirli iş ve işlemlerinden doğan dava ve işlere, bu alanlarda uzmanlaşmış mahkeme olarak Ankara 10, 13 ve 25. İdare Mahkemeleri bakacaktır.

Within this scope, Ankara 10th, 13th and 25th Administrative Courts will hear cases and matters arising from acts and actions in the nature of board decisions of the Turkish Competition Authority, the Capital Markets Board of Türkiye and the Public Oversight, Accounting and Auditing Standards Authority, as well as certain cases and matters arising from specific acts and actions of the Public Procurement Board.

Turkey has introduced comprehensive regulations governing the production, certification, and marketing of cereal seeds, establishing strict quality standards and mandatory variety registration requirements.
