１ はじめに
Bytedance Ltdは、子会社を通じてオンライン・ソーシャル・ネットワーキング・プラットフォームのTikTokを提供している企業である。2023年9月5日の決定により、欧州委員会はBytedanceをDigital Market Act（デジタル市場法）（以下「DMA」という。）に基づくゲートキーパーに指定した 1。2023年11月、Bytedanceはこの指定の取り消しを求めて、European General Court （EGC）2（以下「本裁判所」という。）に訴えを提起した。2024年7月、本裁判所は同社の訴えを棄却する決定を下し（以下「本判決」という。）、同社のゲートキーパーに該当することが改めて確認された。本判決は、DMAの適用基準を正面から取り上げた初めての判決として世界的に注目されているため、本記事で紹介する。
