Senators Pete Ricketts and Elissa Slotkin have introduced bipartisan legislation that would subject American investments in adversary biotechnology to federal review requirements. The Biotech Investment National Security Act would amend the COINS Act to include pharmaceutical and biological product development in the list of sectors requiring Treasury Department screening for outbound investments to countries of concern, particularly China.

On Dec. 10, 2024, the State Administration for Market Regulation released the Guidelines for the Review of Horizontal Business Concentrations (Guidelines).

I personally have dealt with more than two dozen exit ban matters in China. Around half of these were clear, in that the person banned from leaving China was told very explicitly not to leave, and in each case they knew why.
