Investimento Coletivo (os "OIC") e dos
seus participantes ou sócios.
A presente nota descreve sumariamente as
alterações fiscais introduzidas por esta Lei. No
capítulo I são tratadas as alterações
que afetam diretamente os OIC e os seus participantes ou
sócios. No capítulo II são tratadas as demais
alterações, não diretamente relacionadas com
os OIC.
Como nota preliminar e transversal aos dois capítulos,
notamos que o texto da Lei n.º 31/2024, de 28 de junho,
não é claro quanto a um conjunto de aspetos
relevantes, deixando dúvidas em aberto sobre algumas das
disposições alteradas ou adicionadas ao regime
fiscal. É, portanto, expectável que uma parte dos
temas tratados na Lei venha a gerar litígios entre os
contribuintes e a Administração Tributária e
que seja necessário um trabalho aprofundado de
interpretação do regime para consolidar as
soluções.
