Los Angeles Partners Judd Gilefsky and Jeck Dizon recently secured a complete victory for Ford Motor Company, obtaining summary judgment in a Song-Beverly Consumer Warranty action pending in San Joaquin County.
The plaintiffs alleged that Ford was unable to repair a purported vehicle defect after a reasonable number of repair attempts. However, the undisputed evidence demonstrated that the plaintiffs presented the vehicle for no more than a single repair visit. By strategically focusing on deficient discovery responses, the defense successfully obtained an order deeming requests for admission admitted. Those admissions proved critical and ultimately paved the way for the court to grant Ford’s motion for summary judgment on all warranty claims.
