The American Jobs Creation Act of 2004 (the "Jobs Act"), which was signed by the President on October 22, 2004, includes far-reaching changes to the tax laws governing nonqualified deferred compensation. Last month, we sent out a brief Legal Alert describing these changes.
With the benefit of a few weeks to analyze the new law and discuss the implications with Treasury officials and others in the government, we have prepared a detailed analysis of the nonqualified deferred compensation and related provisions of the Jobs Act. In this analysis, we summarize the new law, comment on open issues, and discuss what employers and others can do now to prepare for the January 1, 2005 effective date.
