Regulation Amending the Regulation on Environmental Impact Assessment" ("EIA") ("Amendment Regulation") has been published in the Official Gazette, dated 9 February 2016, numbered 29619 and entered into force on the same date. The Amendment Regulation amends "The Regulation on Environmental Impact Assessment" ("Regulation) which was published in the Official Gazette, dated 25 November 2015 and numbered 29186 as follows:

  • In case of detection that the owner of the project has not complied with the warranties in the final EIA report and in the Project Presentation Documents, the project owner shall fulfill these commitments in a time period given by the Ministry of Environment and Urbanization ("Ministry")/ Governorship. This time period shall be given only once and shall not be longer than a year.
  • The definition of the "Ministry Authorized Institutions/Organizations" has been changed by the Amendment Regulation. The Project owner shall inform the Ministry regarding the start and construction period of the projects which possess an "EIA Positive Report" approved by said Institutions and Organizations regarding the developments of the investment process during the time periods defined by the commission.
  • Audible announcements regarding the EIA process of the project shall be made by municipalities or village headmen, in places where public will be affected or will likely be affected by EIA process.
  • A written announcement regarding the EIA process of the project shall be made in places where public will be affected or will likely be affected by EIA process. This written announcement shall be posted on the wall of the Governor's building, District Governorship's office, Village Headmen's office or Village Council's office.
  • Procedures and principles regarding the planned capacity increase and/or a planned expansion of approved projects regarding the EIA report as "EIA positive" or "EIA not required" shall be defined by the communiqués to be issued by Ministry.
