Malta: Discrimination, Disability & Sexual Harassment

Malta has officially implemented the EU Pay Transparency Directive through new regulations that introduce significant obligations for employers. The rules cover equal pay requirements, salary transparency in recruitment, worker information rights, gender pay gap reporting thresholds, and enforcement measures including tribunal redress and criminal fines.

The introduction of the EU Pay Transparency Directive marked a significant shift in how organisations across the European Union approach pay transparency, workplace equality and gender pay gap reporting.

Malta has implemented the EU Pay Transparency Directive through Legal Notice 173 of 2026, introducing comprehensive regulations on equal pay transparency and reporting that take immediate effect. The new framework establishes requirements for pay categorization, employee information rights, recruitment transparency, and enforcement mechanisms that will fundamentally reshape how pay equity claims are handled in Malta.

The EU Pay Transparency Directive, which came into force on 6 June 2023, must be transposed into national law by all European Member States by 7 June 2026.
