The Insurance Ordinance requires all registered insurers to appoint a representative who must be resident in Gibraltar and be empowered to act generally and to accept service of any document on the insurer's behalf. As most captive insurers do not have their own staff, the general representative will normally be an insurance management company authorised to act as such under the Financial Services Ordinance.

It is illegal for an agent to act on behalf of an insurer which is not licensed in Gibraltar or which does not have its head office in a Member State of the EU and is authorised by that State to carry on insurance business. An agent must be authorised in writing by an insurer to so act.
