Indonesia is implementing a centralized export governance framework through Government Regulation No. 24 of 2026, requiring strategic natural resource commodities including coal, palm oil, and ferro alloy to be exported through a designated state-owned enterprise. This regulatory shift, effective June 1, 2026, may fundamentally alter existing commercial arrangements, shipping logistics, and contractual relationships between Indonesian exporters and offshore buyers.

Trade remedial investigations are often viewed through the lens of determinations of dumping/subsidy, injury and causal link. Yet, some of the most consequential legal questions arise with regard to procedure, which one takes for granted many a time.

The WTO Panel examined whether the European Commission could continue an anti-dumping investigation after the domestic industry withdrew its complaint, and whether parallel anti-dumping and anti-subsidy investigations must be treated identically. Indonesia challenged the EU's decision to proceed with anti-dumping measures on Fatty Acids imports while terminating the parallel anti-subsidy investigation.

Government of the Republic of Indonesia has amended Government Regulation No. 29 of 2021 on the Implementation of the Trade Sector (“GR 29/2021”) through the issuance of Government Regulation No. 3 of 2026 (“GR 3/2026”). In particular, GR 3/2026 was issued and came into force on 15 January 2026.

The Minister of Trade ("MoT") has recently issued MoT Regulation No. 47 of 2025 on Goods Subject to Import Limitation ("MoT Reg. 47/2025"), which took effect on 1 January 2026.
